website www.rbwtoy.com. It owned and run by R.B.W TRADING (L.L.C), Dubai. By accessing or using the rbwtoy.com, however, accessed,
you agree to be bound by these terms of use which comprise the legal terms and
conditions, the E-commerce terms and conditions including Return (Refund)/ Exchange
Policy, the Cancellation Policy and the Privacy Policy (Terms of Use). These
Terms of Use affect your legal rights and obligations.
R.B.W TRADING (L.L.C) (rbwtoy.com) reserves the right to make changes
to the rbwtoy.com and its Terms of Use at any time. Each time you use the
rbwtoy.com, you should visit and review the then current Terms of Use that
apply to your transactions and use of this site. If you no longer accept these
Terms of Use, or any future modification to these Terms of Use, you must close
rbwtoy.com. Continued use of the site indicates your continued acceptance of
these Terms of Use. If, for any reason, we believe that you have not complied
with these Terms of Use, we may, at our sole discretion, cancel your access to
the registration areas of the rbwtoy.com, immediately and without prior notice.
Disclaimers and Limitation of Liability
By using the rbwtoy.com, you expressly agree that use of the
rbwtoy.com is at your sole risk. Neither the rbwtoy.com nor its parent company,
affiliates, subsidiaries or designees nor each of their respective officers,
directors, employees, agents, third-party content providers, designers,
contractors, distributors, merchants, sponsors, licensors or the like
(collectively, Associates) warrant that use of the rbwtoy.com will be
uninterrupted or error-free.
E-commerce Terms and Conditions
Product Display/Colors
We (rbwtoy.com), attempts to display product images shown on
the site as accurately as possible. However, we cannot guarantee that the color
you see matches the product color, as the display of the color depends, in
part, upon the monitor you are using.
Errors on Our Site
Prices and availability of products and services are subject
to change without notice. Errors will be corrected where discovered, and the we
have the right to revoke any stated offer and to correct any errors,
descriptions, specifications, inaccuracies or omissions including after an
order has been submitted and whether or not the order has been confirmed and
your credit card charged. If your credit card has already been charged for the
purchase and your order is cancelled, we will issue a credit to your credit
card account in the amount of the charge. Individual bank policies will dictate
when this amount is credited to your account.
Pricing Policy
Online prices and selection generally match those in our
stores, but may vary. Prices and offers are subject to change but will not be
changed on any order that we accepted.
Prices for Products exclude delivery costs, which if
applicable will be added to the Customer Invoice in accordance with our current
pricing structure (available on request).
It is agreed that the Prices are inclusive of Value Added
Tax (VAT). Where VAT is payable by Rbwtoy the agreed consideration for the
supply shall include the amount of VAT payable applicable at the prevailing
rate at the time the supply is made as a result of applicable legislation in
the United Arab Emirate.
Payment Methods:
You may pay for your orders with the following methods:
Credit/Debit card Online – Generally, credit and debit cards
are not charged until we either ship the item(s) to you or confirm store
availability (at which time you will be charged only for the goods which
actually have shipping charges). However, we may pre-authorize your order amount
with your credit or debit card issuer at the time you place the order, which
may have an effect on your available credit line. When paying for a pre-order
with a debit card you will be charged at the time you place your pre-order.
Please contact your credit card issuer for more information. If an order is
placed by credit card and the order is cancelled for permitted reasons, the
money will be automatically credited back to your bank. This usually takes
10-20 days after rbwtoy.com has initiated the refund, depending on your bank.
Bank Transfer- If you have made a bank transfer and the
order has been cancelled due to permitted reasons, we will offer an online
voucher with the same value which can be redeemed online. No cash refund will
be provided.
Cash on Delivery- If you have made cash payment and the
order has been cancelled due to permitted reasons, we will offer an online
voucher with the same value which can be redeemed online. No cash refund will
be provided.
Credit card on Delivery- If you have made a credit card
payment and the order has been cancelled due to permitted reasons, we will
offer an online voucher with the same value which can be redeemed online. No
cash refund will be provided.
Refunds are subject to timelines from customer’s bank, and we
will not be responsible for any delays once the refund has been issued to the
bank from us.
Note: For all refunds only the value of the item will be
refunded and not the shipping charges.
Using Promotional Codes
Unlike credit or debit cards, Promotional Codes used on
Digital Coupons are debited at the time an order is placed. Digital Coupons
will automatically be redeemed to purchase totals, up to the total purchase
amount. Digital Coupons must be used prior to their noted expiration date and
within a single transaction. Coupons cannot be replaced if lost, stolen,
deleted, or if you cancel or return your purchase. In the event of a reduction
in price below the coupon value, the excess value of the coupon will not be
refunded. Digital coupons and vouchers can be used only on the rbwtoy.com.
Validating Your Order
After you place an order using our shopping cart, we will
check the information you give us for validity, by verifying your method of
payment or shipping address. We reserve the right to reject any order you place
with us, and/or to limit quantities on any order, without giving any reason. If
we reject your order, we will attempt to notify you using the e-mail address
you have given us with the order.
Your credit or debit card will normally not be charged if we
reject an order, but we will process a refund if the charge has been made
against your card.
Order
Acceptance/Confirmation
Your receipt of an electronic or other form of order
confirmation does not signify our acceptance of your order, nor does it
constitute confirmation of our offer to sell. Rbwtoy.com reserves the right at
any time after receipt of your order to accept or decline your order for any
reason.
Order Limitations/Limited Quantities
We may, at its own discretion, limit or cancel quantities
purchased per person, per household or per order. The rbwtoy.com site also
reserves the right to reject any order you place with us. These restrictions
may include orders placed by the same rbwtoy site account, the same credit
card, and orders that use the same billing and/or shipping address. In the
event we make a change to an order, we will attempt to notify you by contacting
the e-mail and/or billing address provided at the time the order was made. The rbwtoy
site reserves the right to limit or prohibit sales to dealers.
Shipping Methods and Fee:
Shipping costs are based on a combination of the following:
Weight and dimensions of your package;
Method of shipment (ground, air, sea, rail etc.);
Location you are shipping from (city, state, country);
Location you are shipping to (the destination country).
We also offer free shipping within the UAE, for orders of
AED 100 and above. Shipping costs to other countries will be calculated on your
shopping cart during checkout.
Costs can be considerably higher for international
destinations, and generally not include additional charges such as duties,
taxes, and customs clearance fees. For example, international rates may include
pickup and door-to-door delivery. Extended Area Surcharges may apply depending
on the international location and is not included in the shipping fees. This
should be paid by the customer receiving the goods.
Shipping Mode:
We have our own courier for deliveries to Dubai and Sharjah,
but use Aramex for deliveries to all other Emirates and for international
orders.
Delivery Time Frame:
Within the UAE: 24-48 hours
Within Dubai & Sharjah: 24 hours
All other Emirates: 48 hours
Within the GCC: 3-7 days
All other international destinations: up to 10 days.
Cancellation Policy
In case we receive a cancellation notice and the order has
not been shipped, we shall cancel the order and refund the entire amount. The
refund process would take 10 to 30 days and would be reimbursed to your credit
card. We will not be able to cancel orders that have already been shipped. The
customer agrees not to dispute the decision made by rbwtoy and accepts the
cancellation policies. For bank transfer order, if payment is not received in 3
days the order will be cancelled automatically.
Termination of Use
Rbwtoy may, in its sole discretion, terminate your account
or your use of the rbwtoy site at any time. You are personally liable for any
orders that you place or charges that you incur prior to termination. The rbwtoy
site reserves the right to change, suspend or discontinue all or any aspects of
the rbwtoy site at any time without prior notice.
Customer Rights
The Consumer Code of Rights was issued under UAE Federal Law
(24) 2006 by the Ministry of Economy (MoE). In Dubai, the Department of
Economic Development's (DED) Commercial Control and Consumer Protection vision
has been charged with the responsibility to ensure that consumers and retailers
alike comply with the Consumer Code of Rights, understand their
responsibilities and, where resolution is sought, facilitate this process
between retailers and consumers.
Disputes and Applicable Law
These Terms and Conditions shall be interpreted and governed
by the laws of the United Arab Emirates. Each party agrees to submit to the
jurisdiction of the courts of Dubai and to waive any objections based upon
venue. Rbwtoy may select to pursue any dispute in any court as it determines in
its sole discretion.
Return and Exchange Policy
RETURN (REFUND) /EXCHANGE POLICY:
If a product is found to be defective or not found to be
working as per the required specifications, the customer shall take the product
to the nearest Rbwtoy shop within 7 days of purchase along with the original
invoice in order to return or exchange.
Refunds for the return will be credited to your rbwtoy
account as Credit, this can be used to purchase any products on our website.
Validity will be 6 Months. In any case where you wish to receive a credit card
refund you can contact our call center.
Products can be
returned only in the country in which they were originally purchased. If the
conditions are satisfied, customer would be paid back the product price
mentioned in the invoice.
The product must be in its original packaging condition
(including instruction manual and all accessories), which means it is unworn,
unopened from shrink wrap or seal opened, unused and in its original condition.
If the conditions are satisfied, customer would be credited Store credit or
refunded the product price mentioned on his invoice or an exchange of a product
up to the value mentioned on the invoice.
The customer has no right to exchange or return (refund) in
the following cases:
A- The product is free from any defects which might harm
customer health and safety.
B- The customer is unhappy with the product for any reason.
C- The customer found the same product or services cheaper
elsewhere.
D- The customer bought the product for someone else who does
not want it for any reason.
E- The customer bought the product, and after sometime they
received a gift from anyone with the same product.
F- Custom-configured and personalized products cannot be
returned, refunded or exchanged.
VALUE ADDED SERVICES:
Pick up, Repair & Delivery T&Cs
- It’s a value-added service applicable within the warranty
period for the products purchased from Rbwtoy website.
- The Product condition will be verified upon receiving the
product at the service center, and the Service Center findings will be
considered as final.
- Customers are not eligible for standby product when
availing from Pick up & Delivery.
- Same-day pick up, repair & delivery service is not
applicable.
- Rbwtoy shall not under any circumstances be liable, either
expressly or implied, for any damages or losses of any kind whatsoever
resulting from loss of, damage to, or corruption of, content or data during
repair or replacement of the product.
- Customers shall pay the repair cost in rbwtoy service
center.
Note on Tax:
VAT Taxes on our products (5 %) being borne by
the RBW Trading LLC. Taxes collected against every transaction will be paid to
the Government by RBW Trading LLC. Please refer www.tax.gov.ae for full details
on VAT.
